Welcome to Boostasong.com, a platform for music promotion. By using our services, you agree to the following terms and conditions. Please read them carefully before proceeding.
1. Definitions
Platform: The website and services provided by us, which connect music content creators ("Submitters") with media outlets (such as blogs, playlists, radios) ("Media").
Credits: The payment system used on the platform for submitting promotions to Media.
Media: Entities (e.g., blogs, playlists, radios) that receive promotional campaigns for review and potential promotion of musical content.
2. Purchase and Use of Credits
Credits purchased for submitting musical promotions on our platform are non-refundable, except as provided in the Refunds section. By purchasing credits, you understand and agree that no refunds or compensations will be granted if credits remain unused or if the outcome of the promotion does not meet your expectations.
3. Platform Functionality
Our platform acts as an intermediary, connecting Submitters with Media for music promotion. We do not manage or control the actions of the Media, so we cannot guarantee the correct use of the platform by Media nor ensure that the promotion will proceed as planned.
4. Media Compensation and Cashback
Media can request cashback for earnings derived from receiving and reviewing promotional campaigns. The cashback will range between 50% and 70% of the value of each campaign received, before transaction and handling fees. Transaction costs are non-refundable.
5. Limitation of Liability
We cannot guarantee the outcome of promotions or the behavior of the Media. The platform is not responsible for any malfunctions, refusals, or lack of response from Media. We do not guarantee that your music will be accepted, promoted, or published by the selected Media.
6. Refunds
If a Media does not provide a response (either acceptance or refusal) to your promotion within 72 hours of submission, the promotion's cost will be refunded in credits, which you may use to submit additional promotions. However, please note that this is the only case where credits may be refunded.
7. Copyright and Uploaded Content
Users uploading content to the platform declare that they hold all the necessary rights to do so. The platform is not responsible for any copyright infringements or violations of other intellectual property laws. Users assume full legal responsibility for the content they upload and agree to indemnify and hold harmless the platform from any claims, disputes, or liabilities arising from the content submitted. In the event of any disputes with third parties or authorities, the user will bear full responsibility.
8. User Suspension or Bans
We reserve the right to suspend or limit access to the platform for any user at any time, without prior notice, if inappropriate behavior or violations of these terms are detected.
9. Data Security and Cybercrime
We are committed to protecting user data and maintaining platform security. However, in the event of a data breach due to cybercrime, we will promptly notify all affected users as soon as we become aware of the breach.
10. Modifications to the Terms and Conditions
We reserve the right to modify these terms and conditions at any time. Changes will take effect upon publication on our website. We encourage you to regularly review this section to stay informed of any updates.

13. Right of Withdrawal
In accordance with Legislative Decree 206/2005 (Consumer Code), users who purchase promotion services on the platform can exercise their right of withdrawal within 14 days of purchase, unless the user has already started using the credits to submit promotions. Once a promotion is submitted, the right of withdrawal for that specific transaction is waived.
14. Limitation of Liability
Boostasong is not liable for any direct or indirect damages arising from the use or inability to use the platform, or from errors or delays in providing services, except in cases of willful misconduct or gross negligence.
15. Governing Law and Jurisdiction
For any disputes concerning the interpretation, execution, or termination of these Terms and Conditions, the court of the consumer’s place of residence or domicile, if located in Italy, will have exclusive jurisdiction.
